Divorce in the UAE — A Guide for Expats

Since Federal Decree-Law No. 41 of 2022, non-Muslim residents of the UAE can divorce under a dedicated civil family law that does not apply Sharia by default. Abu Dhabi's Non-Muslim Family Court was the model; the federal law extends similar rules nationwide.

1. Who the Civil Law Applies To

Any non-Muslim resident or citizen of the UAE may opt into the civil family regime, regardless of nationality. Muslim couples remain under the Personal Status Law unless their home-country law is applied by mutual agreement.

2. Grounds for Divorce

  • No-fault: either spouse may petition without proving cause.
  • No mandatory mediation or reconciliation period.
  • The judgment can be issued in the first hearing if uncontested.

3. Child Custody

The 2022 law introduced joint custody as the default for non-Muslim couples — both parents share legal and physical custody equally unless one is shown to be unfit. Custody disputes are resolved with the child's best interest as the controlling standard.

4. Alimony & Financial Settlement

The court considers years of marriage, financial and non-financial contributions, age of the spouses, education, and whether one spouse caused the breakdown. There is no rigid formula; awards are case-by-case.

5. Procedure

  1. File the divorce petition (Abu Dhabi Civil Family Court or Dubai Court of First Instance — civil circuit).
  2. Serve the other spouse.
  3. First hearing — judgment often issued the same day for uncontested cases.
  4. Custody, alimony, and asset division decided in follow-up hearings if disputed.
  5. Either party may appeal within 30 days.

6. Foreign Divorce Recognition

A divorce granted abroad is generally recognized in the UAE if it does not violate UAE public policy, the foreign court had proper jurisdiction, and the parties were duly summoned.
